Permanent residence applications whilst in Australia on a 457

Whilst you are in Australia on a 457 visa, you may be eligible to apply for permanent residence through a subclass 856 visa application under the Employer Sponsored Nomination (ENS) scheme after EITHER you have obtained a successful pre-application skills assessment from TRA and have 3 years experience in your trade OR you have worked in Australia for at least 2 years without a successful skills assessment (for the last year immediately before the visa application you must have worked for the sponsoring employer). Obviously the ENS approach requires you to have an employer who is willing to provide sponsorship, fulfill a number of employer-related requirements and provide a considerable amount of paperwork to support the sponsorship. You will need police clearances and English language testing. This visa is granted onshore.

Whilst you are in Australia on the 457, you are also able to apply for a subclass 136 (or similar), providing you fulfill all basic requirements and you are able to pass the “points test”. You will need police clearances and English language testing. You need to be offshore to be granted a subclass 136 visa and typically this means a short trip to New Zealand for all the applicants.
