Dear Marlena,
You advertise your company as an expert in Dutch/Australian taxation matters - in most cases, I would imagine, matters more complex than our own. We engaged you on this basis to manage our tax submissions for 2022, 2023, and 2024 - for which you charged us EUR 2,462 (~ $4000 AUD) in respect of our Dutch affairs, and 2,933 AUD where our Australian affairs were concerned.
We assumed your work would be accurate, compliant, and professional.
We now wish to complain to you formally about the accuracy of your Dutch tax submission, specifically for 2024.
We were astounded when we received the Dutch Tax Office’s advice that our combined tax liability in 2024 would be EUR 6,618 (~$11,000) – and contacted the Belastingdienst accordingly. Following several lengthy discussions and related follow-up actions, it became clear to both
the Tax Office and to us that you had made a fundamental error - treating the A.D. [surname] superfund not as a superannuation fund but as an investment – and putting it into Box 3.
Had we not taken these actions ourselves, we would have incurred an entirely avoidable tax liability of EUR 6,618 (~$11,000).
We can back this up with all relevant documentation.
Compensation sought
Given that this is well below the standard of care we were entitled to receive, we now claim a full refund of your 2024 Dutch tax services fee, being EUR 1,562 (~$2,580) – invoices 4500 & 4498.
We would appreciate your favourable reply within 14 days – failing which we will have no choice but to escalate this matter to the relevant professional bodies in the Netherlands.
As for 2025, we have lodged that year’s submission ourselves.
Yours sincerely,
